In this essay I discuss a powerful challenge to high-liberalism: the challenge presented by neoclassical liberals that the high-liberal assumptions and values imply that the full range of economic liberties are basic rights. If the claim is true, then the high-liberal road from ideals of democracy and democratic citizenship to left-liberal institutions is blocked. Indeed, in that case the high-liberal is committed to an institutional scheme more along the lines of laissez-faire capitalism than property-owning democracy. To present and discuss this (...) challenge, I let John Rawls represent the high-liberal argument that only a narrow range of economic liberties are basic rights and John Tomasi represent the neoclassical liberal argument that the full range of economic liberties are basic rights. I show that Rawls’s argument is inadequate, but also that Tomasi’s argument fails. I thus conclude that high-liberalism is in a precarious situation, but is not yet undone by the neoclassical liberal challenge. (shrink)

Driven by a sharp increase in claims for reparations, reparative justice has become a topic of academic debate. To some extent this debate has been marred by a failure to realize the complexity of reparative justice. In this essay we try to amend this shortcoming. We do this by developing a taxonomy of different kinds of wrongs that can underwrite claims to reparations. We identify four kinds of wrongs: entitlement violations, unjust exclusions from an otherwise acceptable system of entitlements, and (...) two kinds where a social practice systematically fails to embody an acceptable system of entitlements. In deliberation about what is required to repair a historical injustice the weight of backward- and forward-looking considerations is a function of the distinctive features of the injustice in question. Hence, the first step in adjudicating claims for reparation is to identify what kind of wrong the claim arises from. From the taxonomy of wrongs we are thus able to construct what we call the Field of Reparative Justice, which illustrates how the structure of deliberation for reparative justice tracks the distinctive features of different kinds of wrongs. The legend of Robin Hood exemplifies a distinct concern of justice neglected by theorists: the distributive results of systemic injustices. Robin Hood’s redistributive activities are justified by the principle that the distributive results of systemic injustices are unjust and should be corrected. This principle has relevance beyond the legend: since current inequalities in the US are results of systemic injustices, the US has good reason to take from the rich and give to the poor.

Holt argues that Rawls’s first principle of justice requires democratic control of the economy and that property owning democracy fails to satisfy this requirement; only liberal socialism is fully democratic. However, the notion of democratic control is ambiguous, and Holt has to choose between the weaker notion of democratic control that Rawls is committed to and the stronger notion that property owning democracy fails to satisfy. It may be that there is a tension between capitalism and democracy, so that only (...) liberal socialism can be fully democratic, but if so, we should reject, rather than argue from, the theory of democracy we find in justice as fairness. In line with the tradition running from Ancients through Christian thought, Kant affirms the idea of moral freedom: that true freedom consists in moral self-determination. The idea of moral freedom raises the problem of moral freedom: if freedom is moral self-determination, it seems that the wicked are not free and therefore not responsible for their wrongdoings. In this essay I discuss Kant's solution to this problem. I argue that Kant distinguishes between four modalities of freedom as moral self-determination and that (...) the problem of moral freedom disappears when these distinctions are brought to light. In this essay I defend a variety of political perfectionism that I call negative perfectionism. Negative perfectionism is the position that if some design of the basic structure of society promotes objectively bad human living, then this should count as a reason against it. To give this hypothetical some bite, I draw on Rousseau’s diagnosis of the maladies of his society to defend two further claims: first, that some human lives are objectively bad, and, second, that some designs of the (...) basic structure promote objectively bad human living. It follows that we have should avoid such designs of the basic structure, which means that negative political perfectionism presents true requirements of justice. (shrink)

Abstract: This paper restates the thesis of 'The Requirements of Justice and Liberal Socialism" where it was argued that liberal socialism best meets Rawlsian requirements of justice. The recent responses to this paper by Jan Narveson, Jeppe von Platz, and Alan Thomas merit examination and comment. This paper shows that if Rawlsian justice is to be met, then non-personal property must be subject to public control. If just outcomes merit the public control of non-personal property and this control (...) is not utilized, then justice has been subordinated to the objectively less important institution of private property. Vor wenigen Tagen hat das Hamburger Kabarett-Theater Schmidts Tivoli die Zusammenarbeit mit dem Komiker Kay Ray beendet, offenbar weil rassistische Witze in der Show einen zentralen Platz einnehmen. Kurz nach der Cancel-Affäre zwischen Lisa Eckhart und dem Hamburger Nochtspeicher sieht sich nun auch Ray als Opfer von „Cancel Culture“, die die Kunstfreiheit immer weiter einschränke. Um die Kunst und Kunstfreiheit geht es dabei aber eigentlich gar nicht. Sie ist nur der Austragungsort gesellschaftspolitischer Auseinandersetzungen um Sexismus, Rassismus und Transphobie. Dabei (...) sind Kunstfreiheit und Meinungsfreiheit zentrale Argumente – oder besser: Waffen – des konservativen politischen Projekts geworden, mit dem emanzipative Änderungen abgewehrt werden (s. auch Schubert, in: Leviathan, 48 (1), S. 29–51). Dieser machtpolitische Missbrauch muss klar von der grundrechtlichen Dimension unterschieden werden. Dafür ist zwischen drei Ebenen Kunstfreiheit zu differenzieren: im nichtstaatlichen, parastaatlichen und staatlichen Bereich. Die Neuregelungen von Diskurs, Kultur und Kunst durch „Politische Korrektheit“, „Cancel Culture“ oder „Identitätspolitik“ bedeuten nicht den Zerfall der Demokratie, sondern sind ein Schritt in Richtung ihrer vollständigeren Realisierung. Ausgehend von der im Wesentlichen auf Immanuel Kant zurückgehenden Vorstellung, dass die Würde des Menschen eng mit seiner Fähigkeit zu selbstbestimmtem Handeln verbunden ist, steht im Zentrum des vorliegenden Aufsatzes der Begriff der Selbstbestimmung resp. der Autonomie. Auch wenn unser modernes Menschen- und Gesellschaftsbild ganz selbstverständlich davon ausgeht, dass jede mündige Person grundsätzlich dazu fähig ist, selbstbestimmt zu handeln, solange sie nicht durch andere Personen oder widrige Umstände daran gehindert wird, treten bei einer vertieften Beschäftigung mit dem Begriff philosophische und (...) naturwissenschaftliche Fragen zu Tage, die alles andere als einfach zu beantworten sind: Was heißt es überhaupt, seine Handlungen selbst bestimmen zu können? Wie kommt die Fähigkeit zur Selbstbestimmung zu Stande? Oder kritischer nachgefragt: Besitzen wir Menschen diese Fähigkeit überhaupt, oder handelt es sich vielleicht in Wirklichkeit nur um eine Illusion, wenn wir davon ausgehen, unser Handeln werde von uns selbst bestimmt? Nach einer kurzen Analyse der Verwendung des Begriffs der Selbstbestimmung in Verbindung mit demjenigen der Menschenwürde und anderen verwandten Begriffen, sollen in diesem Aufsatz verschiedene Spielarten der erwähnten Illusionsthese erörtert und kritisch geprüft werden. Gemeinsam ist ihnen die Behauptung, in einer von Naturgesetzen bestimmten Welt gebe es keinen Platz für einen „Selbstbestimmungs-Mechanismus“, sodass die Vorstellung echter Autonomie im Handeln aufzugeben sei. Das Hauptanliegen meines Beitrags erschöpft sich allerdings nicht darin, diese These zurückzuweisen, sondern es besteht vielmehr darin, ein Gegenmodell vorzustellen, welches die Evolutionsgeschichte der Fähigkeit zur Selbstbestimmung über verschiedene Vorstufen herausarbeitet, um sie von ihren biologischen Wurzeln her als natürliches Phänomen erklärbar zu machen. Schließlich sollen dann im letzten Abschnitt die Konsequenzen aus diesem evolutionären Erklärungsmodell im Hinblick auf Menschenbild und Menschenwürde gezogen werden. (shrink)

Der vorliegende Forschungsband möchte der kulturelle Bedeutung der Ersten Republik und deren Leistungen einen gebührenden Platz einräumen. Während sich nämlich Wiener Moderne und Weimarer Republik heute einer fortdauernden Aufmerksamkeit erfreuen, sind die Kultur der Ersten Republik und hier vorab des soziokulturellen Laboratoriums Wien – vermutlich schon in der Wahrnehmung vieler Zeitgenossinnen und Zeitgenossen unterbelichtet geblieben. Versammelt sind Beiträge zur Volksbildung im Roten Wien, zu Architektur und Stadtplanung, zu neuen Diskursen in der Psychoanalyse oder zur Neuorientierung Musils nach 1918, die (...) später zu seinem epochalen Roman »Der Mann ohne Eigenschaften« führen wird. Was ihn von anderen Publikationen unterscheidet, ist ein komparatistischer Aspekt, der etwa im Vergleich zwischen der Revolution 1918 in Wien und Österreich und der (kurzlebigen) Räterepublik in Ungarn aber auch in der Analyse der ungarischen Medien in der Zwischenkriegszeit zum Ausdruck kommt. Durch diese erhellenden Vergleiche fällt neues Licht auf die spezifische Besonderheit der Ersten Republik und der Situation im Roten Wien. (shrink)

Wenn unsicher geworden ist, wer oder was das bestimmt, was faktisch geschieht, wenn die Welt uns körperlich und seelisch bedrängt und die einzige Gewissheit in der Zukunft unser Tod ist, wenn uns (...) unsere Bedürfnisse und die Grenzen ihrer Befriedigung unklar geworden sind, dann hilft nichts mehr als das Nachdenken – das Nachdenken über unsere Natur und ihren Platz in der Welt, über die Hierarchie unserer Bedürfnisse, darüber, wie wir das Gelingen unseres Lebens mit Vernunft und Gerechtigkeit in Einklang bringen. Kurz, es hilft nichts als der Epikureismus. ********** Do we know who or what determines the course of our lives? Do we even know what is going on inside and outside of us? The only certain thing is our death, but what good is the certainty of our death if it remains uncertain when it will come? We know our needs, but where are the limits to their fulfilment? When it has become uncertain who or what determines what actually happens, when the world oppresses us physically and emotionally and the only certainty in the future is our death, when our needs and the limits of their fulfilment have become unclear to us, then nothing helps more than reflection - reflection on our nature and its place in the world, thinking about the hierarchy of our needs, about how we can harmonise the success of our lives with reason and justice. Wenn wir handeln, greifen wir in den Lauf der Welt ein und führen Veränderungen herbei, von denen wir zu Recht denken, daß sie nicht eingetreten wären, hätten wir nicht eingegriffen. Durch menschliche Eingriffe herbeigeführte Veränderungen machen aber nur einen kleinen Teil dessen aus, was in der Welt geschieht. Der größere Teil geschieht ohne unser Zutun. Beide Arten von Geschehnissen werden sowohl alltagssprachlich wie philosophisch in kausalem Vokabular beschrieben. Handelnde werden als kausale Urheber eines Geschehens verstanden; zugleich sind die mit Handlungen (...) einhergehenden Körperbewegungen kausal in natürliche Verläufe eingebettet: sie haben Ursachen und Wirkungen. -/- Die Studie versteht sich als Beitrag zu einer deskriptiven Metaphysik des Kausal- und des Handlungsbegriffes anhand einer Gegenüberstellung von kausaler Handlungstheorie und Handlungstheorie der Kausalität. Der Neuansatz besteht darin, das Verhältnis von Kausalitäts- und Handlungsbegriff konsequent als eine Gleichung mit zwei Unbekannten zu behandeln. -/- Die Untersuchung besteht aus drei Teilen. Der erste Teil dient einer Darstellung und Kritik der kausalen Handlungstheorie, welche den Kausalbegriff zur Analyse des Handlungsbegriffs verwendet. Ihr zufolge sind Handlungen Körperbewegungen, die sich durch eine besondere kausale Genese auszeichnen. Es zeigt sich, daß eine sachgerechte Lösung der internen Probleme dieser Theorie schlecht mit dem weithin akzeptierten Prinzip vom nomologischen Charakter der Kausalität vereinbar ist. Die Auseinandersetzung mit diesem Prinzip steht im Zentrum des zweiten, kausalitätstheoretischen Teils des Buches. Nancy Cartwright vertritt die These, daß es die strikten empirischen Sukzessionsgesetze, die die nomologische Kausalitätsauffassung erfordert, nicht gibt. Diese These wird ausführlich gegen Einwände aus der Wissenschaftstheorie verteidigt. Es entsteht ein kausalitätstheoretisches Vakuum, dessen Auffüllung der dritte Teil dient. Hier wird der kausalen Handlungstheorie eine Theorie der Kausalität gegenübergestellt, die das Explikationsverhältnis von „handeln“ und „verursachen“ umkehrt: die interventionistische Theorie der Kausalität, derzufolge der gewöhnliche Kausalitätsbegriff nicht erläutert werden kann, ohne den Begriff des absichtlichen Eingreifens in natürliche Verläufe ins Spiel zu bringen. Vorliegende Versionen dieser Theorie sind allerdings von schwerwiegenden Einwänden betroffen (Zirkularität, Anthropomorphismus). Um sie zu entkräften, muß die interventionistische Theorie in der richtigen Weise mit der kontrafaktischen Theorie der Kausalität kombiniert werden. Nur so läßt sich ein begrifflicher Rahmen aufspannen, in dem die durch menschliches Zutun und die ohne menschliches Zutun geschehenden Veränderungen in der Körperwelt gleichermaßen Platz finden, ohne daß neben der gewöhnlichen Ereigniskausalität eine zweite Art von Verursachung („Akteurskausalität“, „Kausalität aus Freiheit“) angenommen werden muß. Menschen sind häufig nicht ganz bei der Sache. Oft finden wir sie abwesend, nicht ganz da, sich in Tagträume verlierend, in Gedanken schon bei der nächsten Sache; finden sie irgendwie nicht ganz hinein in die Situationen, mit denen sie sich gerade konfrontiert finden. Der Beitrag entwickelt die These, dass die Rede von der "Immersivität" von Erfahrung nicht erst bei technologisch oder ästhetisch mediierten Erlebnissen des Versetztseins in künstliche oder virtuelle "Welten" und Umgebungen am Platz, gewöhnliche menschliche Erfahrung vielmehr ganz (...) grundsätzlich durch eine immersive Dynamik des Hineinfindens in und Hinausgeratens aus Situationen charakterisiert ist: Noch bevor wir uns ein bewusstes Bild konkreter Umstände und Möglichkeiten gemacht haben, finden wir uns gewöhnlich schon in Situationen verortet. Diese zeichnen bestimmte Rhythmen und Richtungen, Valenzen und Tendenzen, Bedeutsamkeiten und Möglichkeiten vor. Der Beitrag skizziert eine Phänomenologie der Immersion, die auch ein tieferes Verständnis technologisch oder ästhetisch mediierter Immersionserfahrungen verspricht. (shrink)

Die Aufgabe der Philosophie besteht nicht darin, den moralischen Zeigefinger zu erheben und vorzugeben, was man tun soll und was nicht. Vielmehr zeigt die Philosophie unterschiedliche Argumente auf, weshalb die eine oder andere Haltung vertretbar oder aus gewissen Gründen gegebenenfalls vertretbarer ist als eine andere. Insofern eine Gesellschaft an Klugheit interessiert ist und sich einer zukünftigen Entwicklung verantwortungsvoll stellt, kann die Philosophie eine wertvolle Aufgabe übernehmen: Die Methode, analytisch das Für und Wider abzuwiegen, bedeutet nicht zuletzt viel Arbeit und Aufmerksamkeit (...) für das Detail. Wie beispielsweise das Kapitel zur Grünen Gentechnik (Seite 6) zeigt, sind die Diskussionen um die zu fällenden moralischen Urteile nicht an ein externes Gremium zu delegieren. Im Gegenteil: Die Diskussion sollte innerhalb der Gesellschaft stattfinden, einerseits um den unterschiedlichen Haltungen Platz zu geben, andererseits aber, weil nur auf diese Weise ein echter Konsens zu Stande kommen kann. Die Rolle der Philosophie zeigt sich ähnlich auch, wenn es um die für die pluralistische Gesellschaft zentrale Toleranz geht. Die wertenden Einstellungen der Bürgerinnen und Bürger verdienen es, ernst genommen zu werden und offen diskutiert zu werden. Nur durch eine tiefgreifende Auseinandersetzung lässt sich verhindern, dass populistische Wortführer mit eigennützigen, aber aufmerksamkeitsstarken Argumenten von den Themen ablenken, die ernsthaft angegangen werden möchten: Die Vision einer friedlichen und freiheitlichen Gesellschaft, das demokratische Ideal, wird nicht mit dem Verweis auf die „Krise“ aufgegeben. Verantwortung interessiert die Bürgerinnen und Bürger schliesslich eben doch mehr, als Donald Trumps neuste Lüge. Das philosophische Themendossier zeigt, dass die akademische Philosophie viel leis-tet, um eine oberflächliche Auseinandersetzung mit gesellschaftlich und zukunftsrelevanten Themen zu verhindern. Auch wenn das auf den ersten Blick nach viel Anstrengung klingt, so zeigt der zweite Blick, dass darin viel Wohlwollen zugunsten der Gesellschaft steckt. Es lohnt sich, den Mut aufzubringen, sich intensiv mit den eigenen Werturteilen auseinanderzusetzen und das Auge vom eigenen Wohl auch auf das Wohle aller schweifen zu lassen. Philosophie kann „ansteckend“ sein und viel Freude hervorrufen: Gerade dann, wenn man neue Ideen mit dazu gewinnt oder andere Argumente für bereits gefasste Entscheidungen kennenlernt. Die Philosophie entwickelt sich fortlaufend weiter und bleibt somit mehr denn je: stets aktuell. (shrink)

According to the order ethics approach to business ethics, moral rules must be im-plemented by institutions that provide incentives for following the rules. As a minimal (normative) condition, these institutions must be able to motivate the homo eco-nomicus. But even if an institution passes this test, it will only motivate actual people (i.e. the homo psychologicus) to follow moral rules, if they have the relevant compe-tences and self-efficacy beliefs. Consequently, good institutional design includes com-prehensive change management. At this point applied (...) order ethics can draw on find-ings of psychology and experimental economics. It turns out, that role models can support self-efficacy beliefs and are thus more important for order ethics than has traditionally been assumed. (shrink)

This Article outlines a vision of responsible innovation and outlines a public policy and implementation strategy for it.

The concept of innovation has entered a turbulent age. On the one hand, it is uncritically understood as ‘technological innovation’ and ‘commercialized innovation.’ On the other hand, ongoing research under the heading responsible research and innovation suggests that current global issues require innovation to go beyond its usual intent of generating commercial value. However, little thought goes into what innovation means conceptually. Although there is a focus on enabling outcomes of innovation processes to become more responsible and desirable, the technological (...) and commercial nature of these processes is rarely questioned. For these reasons, this paper poses the following research question: what concept of innovation is implicitly taken up by the RRI discourse and what implications does this concept have for the societal purpose of RRI? As a first step, we analyze the extent to which the concept of innovation in the RRI literature is uncritically presupposed to be technological. Subsequently, we examine the diverse meanings innovation has had over time and argue that while innovation originally had a political connotation it is only recently restricted to the meaning of technological innovation. We go on to show that even though the concept of technological innovation can contribute to the societal purpose of RRI, this requires certain conditions that are difficult to guarantee. Consequentially, we argue that future research should explore alternative understandings of innovation that better enable the overall feasibility of the emerging frameworks of RRI. (shrink)

ABSTRACTAchievements are among the things that make a life good. Assessing the plausibility of this intuitive claim requires an account of the nature of achievements. One necessary condition for achievement appears to be that the achieving agent acted competently, i.e. was not just lucky. I begin by critically assessing existing accounts of anti-luck conditions for achievements in both the ethics and epistemology literature. My own proposal is that a goal is reached competently, only if the actions of the would-be-achiever make (...) success likely, and that this is the reason why she acts that way. (shrink)

Achievements have recently begun to attract increased attention from value theorists. One recurring idea in this budding literature is that one important factor determining the magnitude or value of an achievement is the amount of effort the achiever invested. The aim of this paper is to present the most plausible version of this idea. This advances the current state of debate where authors are invoking substantially different notions of effort and are thus talking past each other. While the concept of (...) effort has been invoked in the philosophical analysis of a number of important concepts such as desert, attention, competence, and distributive justice, it has hardly ever been analyzed itself. This paper makes headway in this regard by discussing three ambiguities in the everyday notion of effort. It continues to develop two accounts of effort and shows how both of them are achievement-enhancing. (shrink)

This paper critically assesses existing accounts of the nature of difficulty, finds them wanting, and proposes a new account. The concept of difficulty is routinely invoked in debates regarding degrees of moral responsibility, and the value of achievement. Until recently, however, there has not been any sustained attempt to provide an account of the nature of difficulty itself. This has changed with Gwen Bradford’s Achievement, which argues that difficulty is a matter of how much intense effort is expended. But while (...) this account captures something important about the relationship between difficulty and achievement, it fails to account for the fact that part of what makes achievements great is that they are difficult in a moderately agent-neutral kind of way. Nor is this thought captured by any other extant account. I argue that to fill this gap we should think of difficulty in terms of low probability of success. (shrink)

According to the Market Failures Approach to business ethics, beyond-compliance duties can be derived by employing the same rationale and arguments that justify state regulation of economic conduct. Very roughly the idea is that managers have a duty to behave as if they were complying with an ideal regulatory regime ensuring Pareto-optimal market outcomes. Proponents of the approach argue that managers have a professional duty not to undermine the institutional setting that defines their role, namely the competitive market. This answer (...) is inadequate, however, for it is the hierarchical firm, rather than the competitive market, that defines the role of corporate managers and shapes their professional obligations. Thus, if the obligations that the market failures approach generates are to apply to managers, they must do so in an indirect way. I suggest that the obligations the market failures approach generates directly apply to shareholders. Managers, in turn, inherit these obligations as part of their duties as loyal agents. (shrink)

Theories of well-being that give an important role to satisfied pro-attitudes need to account for the fact that, intuitively, the scope of possible objects of pro-attitudes seems much wider than the scope of things, states, or events that affect our well-being. Parfit famously illustrated this with his wish that a stranger may recover from an illness: it seems implausible that the stranger’s recovery would constitute a benefit for Parfit. There is no consensus in the literature about how to rule out (...) such well-being-irrelevant pro-attitudes. I argue, first, that there is no distinction in kind between well-being-relevant and irrelevant pro-attitudes. Instead, well-being-irrelevant pro-attitudes are the limiting cases on the scale measuring how much of a difference pro-attitudes make to the subject’s well-being. Second, I propose a particular scalar model according to which the well-being-relevance of pro-attitudes is measured by either their hedonic tone, or by the subject’s conative commitment. (shrink)

Responsible Research and Innovation (RRI) reflects an innovation paradigm that acknowledges that market innovations do not automatically deliver on socially desirable objectives, and requires a broad governance of knowledge coalitions of governmental bodies as well as industrial and societal actors to address market deficits. Responsible Innovation should be understood as a new paradigm for innovation which requires institutional changes in the research and innovation system and the public governance of the economy. It also requires the institutionalisation of an ethics of (...) co-responsibility as well as the introduction of new standards and certification processes for products. Among recent developments in the anthropological sciences, hardly any have found so much attention and led to so much controversy as have the views advanced by the late Benjamin Whorf.The hypothesis offered by Whorf is,“that the commonly held belief that the cognitive processes of all human beings possess a common logical structure which operates prior to and independently of communication through language, is erroneous. It is Whorf's view that the linguistic patterns themselves determine what the individual perceives in this world (...) and how he thinks about it. Since these patterns vary widely, the modes of thinking and perceiving in groups utilizing different linguistic systems will result in basically different world views”.“We are thus introduced to a new principle of relativity which holds that all observers are not led by the same physical evidence to the same picture of the universe, unless their linguistic backgrounds are similar. … We cut up and organize the spread and flow of events as we do largely because, through our mother tongue, we are parties to an agreement to do so, not because nature itself is segmented in exactly that way for all to see”. Integrity not only is a central concept within virtue ethics and a subject of considerable debate among philosophers regarding its nature and relation to other virtues, but also is important for our understanding of what it means to possess a constituted and coherent self. Much of the literature on integrity is focused on relationships among moral principles and virtues, while less attention is paid to any relationship that integrity might have to practical agency or personal identity. In maintaining this focus, (...) philosophers fail to appreciate the special relation integrity has to the constitution of a coherent self. Central to integrity are considerations about self-identity and agency because it is through ongoing and deliberate activities that reflect the type of person with which she wishes to identify that a person constitutes self-identity and agency in a coherent manner. Once the relationship between integrity and a coherent self is properly understood, it becomes clear that the moral content of integrity is relatively thin and that the approbation usually associated with a person of integrity stems not from judgments about convictions or principles, but from the relationship between actions and commitments. We reflect on a decade of Responsible Research and Innovation (RRI) as a discourse emerging from the European Commission (EC) 10 years ago. We discuss the foundations for RRI, its emergence during the Seventh Framework programme and its subsequent evolution during Horizon 2020. We discuss how an original vision for RRI became framed around five so-called ‘keys’: gender, open access, science communication, ethics and public engagement. We consider the prospects for RRI within the context of the EC’s Open Science agenda (...) and Horizon Europe programme, before closing with some reflections on the contribution RRI has made to debates concerning the relationship between science, innovation and society over the last decade. Open science will make science more efficient, reliable, and responsive to societal challenges. The European Commission has sought to advance open science policy from its inception in a holistic and integrated way, covering all aspects of the research cycle from scientific discovery and review to sharing knowledge, publishing, and outreach. We present the steps taken with a forward-looking perspective on the challenges laying ahead, in particular the necessary change of the rewards and incentives system for researchers (for which various actors (...) are co-responsible and which goes beyond the mandate of the European Commission). The precautionary principle in public decision making concerns situations where following an assessment of the available scientific information, there are reasonable grounds for concern for the possibility of adverse effects on the environment or human health, but scientific uncertainty persists. In such cases provisional risk management measures may be adopted, without having to wait until the reality and seriousness of those adverse effects become fully apparent. This is the definition of the precautionary principle as operationalized under EU law. The precautionary (...) principle is a deliberative principle. Its application involves deliberation on a range of normative dimensions which need to be taken into account while making the principle operational in the public policy context. Under EU law, any risk management measures to be adopted while implementing the precautionary principle, have to be proportionate to ensure the chosen high level of protection in the European Community. This articlewill illustrate the established practice concerning the release of genetically modified organisms into the environment and how the principle is implemented under hard law. The article also provides an outlook on what this may imply for the relative new case of nanotechnology and the use of precautionary principle within the context of soft law (use of codes of conduct). Western societies are experiencing a crisis of trust: we no longer enjoy high levels of confidence in social institutions and are increasingly skeptical of those holding positions of authority. The crisis of trust, however, seems paradoxical: at the same time we report greater feelings of mistrust or an erosion of trust in institutions and technologies we increasingly entrust our wellbeing and security to these very same technologies and institutions. Analyzing trust not only will help resolve the paradox but suggests that (...) the crisis entails normative expectations linked to collective identity, and as such, trust can be understood as a public virtue. In this paper I confront what I take to be the crucial challenge for fictional realism, i.e. the view that fictional characters exist. This is the problem of accounting for the intuition that corresponding negative existentials such as ‘Sherlock Holmes does not exist’ are true (when, given fictional realism, taken literally they seem false). I advance a novel and detailed form of the response according to which we take them to mean variants of such claims as: there is no concrete (...) x such that x is Sherlock Holmes. (shrink)

It is widely held that our beliefs can be epistemically faultless despite being morally flawed. Theories of moral encroachment challenge this, holding that moral considerations bear on the epistemic status of our attitudes. According to attitude-based theories of moral encroachment, morality encroaches upon the epistemic standing of our attitudes on the grounds that we can morally injure others with our epistemic practices. In this paper, I aim to show that current attitude-based theories have asymmetric mechanisms: moral features only make it (...) harder for attitudes to secure epistemic merits. I argue that, if attitudes can incur moral injury, failure to form attitudes can too. To make sense of this, I contend, attitude-based accounts require symmetric mechanisms, allowing that moral considerations make it both harder and easier for attitudes to attain epistemic merits. I maintain that, once we recognize this, attitude-based encroachment views must soon concede that they sometimes demand we believe against the evidence. (shrink)

This book features the contribution of major European research projects on the governance and ethics of Nanotechnology. They focus on the responsible development of nanotechnology and on the understanding of public debate.

Wie sollen individuelle, miteinander konkurrierende Ansprüche gegeneinander abgewogen werden? Die gerechtigkeitstheoretischen Herausforderungen wachsen, wenn künftige Personen mit einbezogen werden. Mit dem Schritt von rein intra- zu intergenerationeller Gerechtigkeit sind die Ansprüche nicht mehr nur im Raum, sondern auch in der Zeit verteilt. Dieser Beitrag widmet sich der Frage, auf welche Weise die so verteilten Ansprüche zusammengeführt werden sollen. Dazu wird zwischen einer synchronen und einer diachronen Gerechtigkeitskonzeption unterschieden. Erstere sieht die zeitliche Dimension als Erweiterung der räumlichen: Zunächst setzt sie jene (...) Ansprüche, die zu einem gegebenen Zeitpunkt innerhalb einer Generation existieren, zueinander in Beziehung. Die so zusammengeführten generationellen Ansprüche werden anschließend entlang der Zeit gegeneinander abgewogen. Letztere hingegen verwirft die Generation als relevante Gruppe, um die Bedürfnisse des Individuums zu vertreten. Stattdessen basiert sie auf der Idee transgenerationeller Gemeinschaften. Sie stellt individuelle Ansprüche zunächst innerhalb der jeweiligen, zeitlich ausgedehnten Gemeinschaft einander gegenüber. Anschließend setzt sie dann diese Gemeinschaften zueinander in Beziehung. Bestehende Theorien generationenübergreifender Gerechtigkeit verfolgen dabei zumeist eine Extensionsstrategie: Sie erweitern eine bestehende intragenerationelle Theorie um die zeitliche Dimension hin zur Intergenerationalität. Dies entspricht einer synchronen Konzeption, die jedoch oftmals nichts expliziert wird. Demgegenüber entwickelt der Beitrag zwei Argumente für die diachrone Alternative. Konzentrieren wir uns weniger auf Forderungen ganzer Generationen, sondern auf Bedürfnisse künftiger Mitglieder unserer transgenerationellen Gemeinschaften, so werden wir, erstens, der motivationalen Herausforderung besser gerecht werden. Sie besteht in der Beantwortung der Frage, warum wir im heutigen Handeln überhaupt Raum für nachfolgende Interessen schaffen sollten. Innerhalb transgenerationeller Gemeinschaften stehen diese nachfolgenden Interessen jedoch nicht in Isolation, sondern sind durch Interaktion innerhalb der Gemeinschaft geprägt und erlauben uns damit, unsere eigenen Interessen über das eigene Leben hinaus zu verwirklichen. Zweitens können wir so auch der epistemischen Herausforderung begegnen. Diese stellt sich angesichts der Frage, worin eigentlich die nachfolgenden Interessen bestehen. Greifen wir sie nicht als kollektive Wünsche ganzer Generationen auf, sondern als die Pläne und Projekte künftiger Mitglieder unserer Gemeinschaft, so wird es leichter sein, vom Heute auf die Zukunft und ihre Bedürfnisse zu schließen. Die Forderung, künftige Ansprüche im heutigen Handeln zu berücksichtigen, wirft die Frage nach dem ‚Warum‘ und die nach dem ‚Wie‘ auf. Beiden kann eine diachrone Konzeption intergenerationeller Gerechtigkeit eher begegnen. (shrink)

This article argues that shareholder primacy cannot be defended on the grounds that there is something special about the position of shareholders that grounds a right to preferential treatment on part of management. The notions of property and contract, traditionally thought to ground such a right, are now widely recognized as incapable of playing that role. This leaves shareholder theorists with two options. They can either abandon the project of arguing for their view on broadly deontological grounds and try to (...) advance consequentialist arguments instead, or they can search for other morally relevant properties that could ground shareholder rights. The most sustained argument in the latter vein is Marcoux’s attempt to show that the vulnerability of shareholders mandates that managers are their fiduciaries. I show that this argument leads to the unacceptable conclusion that it would be unethical for corporations to make incomplete contracts with nonshareholding stakeholders. (shrink)

‘Enlightenment’ (in German, ‘Aufklärung’) is not simply the name of a movement or development whose existence is uncontroversial. Rather, the claim ‘The 18th century was the age of enlightenment’ or ‘In Germany, there was the Enlightenment’ entail certain claims which need to be discussed. This article argues that some of these claims are false and that therefore the claim ‘The Enlightenment does not exist’ is true.

Many authors hold that we cannot have the kind of free will that we seem to have. This article spells out and defends that kind of free will. Most libertarians hold that a free action involves a probabilistic process at some stage. Like the compatibilists, I hold that this is not only not required for free will but even reduces or excludes freedom. But contrary to the compatibilist and contrary to most libertarians, I claim that free will requires that we (...) can bring about events that have no preceding cause. That is what our experience suggests, and there are no beliefs that contradict this and are justified. (shrink)

This article criticises Alvin Plantinga’s claim that ‘basic’ design beliefs, which arise without a conscious inference, have more positive epistemic status than non-basic ones and that we cannot evaluate the probabilities involved in inferential, inductive design arguments.

My analysis takes as its point of departure the controversial assumption that contemporary ethical theories cannot capture adequately the ethical and social challenges of scientific and technological development. This assumption is rooted in the argument that classical ethical theory invariably addresses the issue of ethical responsibility in terms of whether and how intentional actions of individuals can be justified. Scientific and technological developments, however, have produced unintentional consequences and side-consequences. These consequences very often result from collective decisions concerning the way (...) we wish to organise our economies and society, rather than from individual actions. It has been apparent for a long time now that it is not sufficient to construct an ethics of science and technology on the basis of the image of a scientist who intentionally wants to create a Frankenstein. Thus, as a minimum we would require an ethical framework that addresses both the aspect of unintentional side consequences (rather than intentional actions) and the aspect of collective decisions (rather than individual decisions) with regard to complex societal systems, such as the operation of our economy. We do not have such a theory available. More disturbing than the principle shortcomings of ethical theory are the shortcomings of conventional ethical practice with respect to technological developments. Below I will suggest how four different developments can illustrate these shortcomings, which centre around the fact that individuals in our society can simply not be held fully accountable for their individual role within the context of scientific technological developments. I will call these shortcomings of a theory (and practice) of individual role responsibility. This may help us to reflect on robotics too, insofar as robots may be perceived as replacements for “roles”. From there, I will argue why we have to shift our attention to an ethics of knowledge assessment in the framework of deliberative procedures. (shrink)

In diesem Eintrag werden zwei miteinander zusammenhängende Aspekte betrachtet. Nun betreffen diese zwei Aspekte aber nicht ontologische Fragen erster Ordnung, d. h. Fragen, was es gibt. Vielmehr sind es Fragen zweiter Ordnung, ›metaontologische‹ Fragen dazu, wie philosophisch untersucht werden sollte, was es gibt. Der Fokus dieses Eintrags liegt dabei auf der Standardauffassung ontologischer Untersuchung, die die philosophische Literatur der letzten Jahre dominiert hat. Diese Auffassung haben wir zum größten Teil dem Einfluss von Willard Van Orman Quine zu verdanken.

Einige versuchen, Wunder mit den Naturgesetzen vereinbar zu machen, indem sie „Wunder“ als etwas anderes als göttliche Eingriffe definieren. Dieser Aufsatz behauptet hin- gegen, daß Wunder die Naturgesetze nicht verletzen, obwohl sie göttliche Eingriffe sind. Wunder sind auch keine „Ausnah- men“ der Naturgesetze, noch treffen die Naturgesetze nicht auf sie zu. Naturgesetze haben nie Ausnahmen, sie werden nie verletzt oder ausgesetzt, sie sind wahrscheinlich notwen- dig und unveränderlich, und sie treffen auch auf göttliche Ein- griffe zu. Wir sollten nicht unsere (...) Vorstellung von Wundern, sondern unsere Vorstellung der Naturgesetze in Frage stel- len. Die Hauptthese dieses Aufsatzes ist, daß Naturgesetze keine Abfolgeregelmäßigkeiten implizieren und daß deshalb Wunder die Naturgesetze nicht verletzen. Wir brauchen eine neue Theorie der Naturgesetze: die Tendenztheorie. (shrink)

Die liberale Theologie geht davon aus, daß man die traditionelle christliche Lehre heute nicht mehr glauben kann und daß man sie deshalb verändern muß. Sie will sich nicht vom Christentum offen absagen, sondern das Christentum verändern oder eine neue Version des Christentums einführen. Radical Orthodoxy (RO), vor allem von John Milbank gegründet, will eine Gegenbewegung dazu sowie zum Säkularismus sein: „A theology which claims to be radical and orthodox“. In diesem Aufsatz möchte ich untersuchen, ob sie es wirklich ist, und (...) ich werde Indizien dafür vorstellen, daß sie es nicht ist. Vor diesem Hintergrund werde ich dann die Analytische Religionsphilosophie (oder Analytische Theologie) als Alternative vorstellen. (shrink)

On Jaakko Hintikka’s understanding of Aristotle’s modal thought, Aristotle is committed to a version of the Principle of Plenitude, which is the thesis that no genuine possibility will go unactualized in an infinity of time. If in fact Aristotle endorses the Principle of Plenitude, everything becomes necessary. Despite the strong evidence that Aristotle indeed accepts that Principle of Plenitude, there are key texts in which Aristotle seems to contradict it. On Hintikka’s final word on the matter, Aristotle either endorses the (...) Principle of Plenitude or Aristotle is simply inconsistent. Without challenging Hintikka’s interpretation of the relevant texts, I show how Aristotle may accept a form of the Principle of Plenitude that allows for genuine unactualized possibilities in the world. What allows me to reconcile the seemingly inconsistent data is to show how Aristotle is only committed to a de re version of the Principle of Plenitude. After I lay out my proposal, I show how it opens up new ways in which we might understand Aristotle’s attempt to reject fatalism in his De interpretatione 9. (shrink)

Jones and Felps claim that social welfare would be enhanced, if corporate managers adopted the goal of directly improving the happiness of their stakeholders instead of profit maximization. I argue that their argument doesn’t establish this. They show that a utilitarian case for profit orientation cannot be made from the armchair. But neither can the case for Jones and Felps’ preferred alternative. And their defense of it relies on empirically unsubstantiated assumptions.
